What Our Clients Say

" Roger and his team have been like family to our family since this ordeal had begun. We lost our son some years ago and those whom we felt responsible offered not as much as an apology for their hand in his death. We then decided to get a lawyer, but no one wanted to take our case as we were going up against a GIANT here in Georgia. We then decided to go outside of our small town and then we found Roger. He honestly told us that he would look into our potential case and if there was something there....he would give us a call. That call came and our journey began. There were ups and downs throughout the process but it was explained to us by Roger in the beginning that this would be a tough case. We were notified throughout on where we stood and we were never kept in the dark about what was going on. Needless to say that our case has concluded and we were pleased with the results. Did I mention we were up against a GIANT? Thank you Roger and to your staff we offer gratitude and thanks."

Shaun Jimenez

" I would strongly recommend Roger Krause in a wrongful death case. He is very passionate about the cases and puts his clients first. He obtained justice for our family and because of this a policy for the hospital was changed to hopefully keep other family members from going through what we have had to endure."

What Does Georgia Law Say About Wrongful Death Lawsuits?

Wrongful death lawsuits are allowed in Georgia only under statutory law – meaning that the law was specifically passed by the legislature and signed by the Georgia Governor.

Survivors or family members “may recover for the homicide of the spouse or parent the full value of the life of the decedent, as shown by the evidence” according to legal code O.C.G.A. § 51-4-2(a). This is a process which includes both an economic analysis, i.e. how much money would the loved one make, as well as the value of the enjoyment of life.

For someone to receive full damages or full compensation, sometimes you must also recover under an ‘estate’. An estate is created in the probate court that collects all the assets and liabilities of the decedent. Once an Estate is created, then, under Georgia’s wrongful death statute, O.C.G.A. § 51-4-5(b), whereby the Estate recovers the pain and suffering of the decedent, between the time of the wrongdoing and the death. Whether you should you create an estate depends on the facts of your case. Really, only wrongful death lawyers know.

On top of this, in Georgia, the only people who can file for a wrongful death lawsuit is a child, parent or spouse of the person who died. Although others who are affected by your loved one’s untimely passing may also want to seek justice, the rights are reserved to the aforementioned family members.
